Terms of Service

1. Acceptance of Terms

By registering for Inspired Swim lessons or using our website, you agree to these Terms of Service. If you are registering a minor, you represent that you are their parent or legal guardian and agree to these terms on their behalf.

2. Swimming Lesson Services

2.1 Registration

• Registration is on a first-come, first-served basis
• Full payment is required to secure your spot
• Class placement is based on age and skill assessment
• Maximum class size is 3 students per instructor

2.2 Schedule

• Lessons run year-round with seasonal sessions
• Classes may be rescheduled due to facility availability or weather
• We will provide minimum 24-hour notice for schedule changes when possible

2.3 Instructor Qualifications

All Inspired Swim instructors are certified by recognized swimming organizations and maintain current First Aid and CPR certifications.

3. Payment Terms

• Payment is due upon registration
• We accept all major credit cards
• Seasonal sets require full payment at time of registration
• NSF fees may apply for failed payments
• Prices are subject to change with 30 days notice

4. Cancellation and Refund Policy

4.1 By Customer

• All seasonal set payments are non-refundable
• Make-up lessons are not guaranteed but we will do our best to accommodate when availability permits
• Cancellations should be communicated as early as possible to allow for potential rescheduling
• No-shows: No make-up lesson provided

4.2 By Inspired Swim

If we cancel a lesson due to instructor unavailability or facility issues, we will do our best to reschedule or provide a make-up lesson. We reserve the right to cancel programs with insufficient enrollment.

5. Health and Safety

5.1 Medical Conditions

You must disclose any medical conditions, allergies, or special needs that may affect participation. We reserve the right to require medical clearance for certain conditions.

5.2 Safety Rules

• Students must follow all instructor and facility safety rules
• Parents must supervise non-swimming children at all times
• No running on pool decks
• Appropriate swimwear is required

5.3 Assumption of Risk

Swimming involves inherent risks. By participating, you acknowledge these risks and agree that Inspired Swim is not liable for injuries except in cases of gross negligence.

6. Code of Conduct

All participants and spectators must:

• Treat instructors, staff, and other participants with respect
• Follow facility rules and regulations
• Refrain from disruptive or inappropriate behavior
• Respect pool property and equipment

We reserve the right to dismiss participants who violate our code of conduct without refund.

7. Photography and Media

We may photograph or video lessons for training, promotional, or safety purposes. By participating, you grant us permission to use such media. If you prefer not to be photographed, please notify us in writing.

8. Liability and Indemnification

To the maximum extent permitted by law:

• Inspired Swim is not liable for lost or stolen personal property
• Our liability is limited to the amount paid for services
• You agree to indemnify us against claims arising from your violation of these terms

9. Intellectual Property

All content on our website, including text, images, logos, and curriculum materials, is owned by Inspired Swim and protected by copyright laws. Unauthorized use is prohibited.

10. Making Waves Scholarship Program

Our Making Waves program provides subsidized lessons for qualifying families. Separate terms and eligibility requirements apply. Contact us for more information.

11. Dispute Resolution

Any disputes will be resolved through good faith negotiation. If necessary, disputes will be settled through binding arbitration in accordance with the laws of the province where services are provided.

12. Changes to Terms

We may update these terms periodically. Significant changes will be communicated via email. Continued use of our services after changes constitutes acceptance.
